Can I sue a hospital?
I work at a big laundromat where we wash linen for alot of hospitals around the area.. Today while I was taking some linen out of a bag I got cut by a scalpel on my hand.. I had to go to the hospital to get stitches and have blood drawn to check for infections (HIV,HBV,HVC) .. Well I was wondering if there is any legal actions I can take against that hospital for being negligent and not disposing that scalpel properly? What if I do contract some type of illness from that?
It wasn't a minor injury.. I have a huge deep cut from the tip of my thumb to my wrist.. Im having a hard time doing anything now because I cant close my right hand.. Which I am right handed. Also what if I end up getting HIV because the person who had surgery on them with that scalpel was HIV positive?
And I did get tested today.. For all three of those diseases.. I'm not trying to be an assss but they really should be more careful with the way they dispose of those things.
You cannot sue the hospital. You were injured at work, you will qualify for Worker's Compensation. They will cover your losses. Apparently NONE of the people above know how work related injuries are treated?
OSHA may investigate your employer for allowing a risk in handling something that may have a sharp implement, but that is between them and OSHA. Hospitals ARE careful, but accidents can happen.
